EU Dual-Use Regulation (2021/821).
According to your public documentation, the Wireshark network protocol analyzer falls under U.S. ECCN 5D002 and qualifies for License Exemption TSU under Section 734.3(b)(3) of the EAR.
Could
you please formally confirm this classification for our compliance tracking records?
Additionally, as we are an EU-based entity, please explicitly confirm whether the software is considered not listed or decontrolled under Regulation (EU) 2021/821 Annex I due to the Cryptography Note (Category 5 Part 2 Note 3) and the Public Domain / General
Software Note (GSN) exclusions.
