I checked with the Vendor and got this answer:

This is a know issue  issue and there is already a DDTS opened to correct the
behavior. This is being tracked under DDTS:CSCup99146 - ERSPAN Tyep2 & Type3
packet have incorrect outer IP length. N5K will also be addressed in this DDTS.
A DE has already been assigned to get this issue resolved. We do not have any
ETA at the moment.
