This might be a bug in 3.1 beta 4. Try un-installing 3.1 beta 4 and installing the released version of WinPcap 3.1.
If that still doesn't work, are you trying to capture on an 802.11 adapter? Promiscuous mode often doesn't work well on those adapters on Windows:
