I have been running into the "if there is no-one to sue then you can not
run that software here" mentality for years.

On the other hand, I've never seen them sue someone for non-operational
software. Suing seems unlikely since most disclaimers say they do not
guaranetee the software do do anything beyond using up your disk space.
